The applicants seek to condone delay of 1350 days in bringing legal heirs of one of the claimants i.e. Vishwanath Ladappa Karande and setting aside abatement. The cause of action survives against the legal heirs of deceased claimant Vishwanath. They are necessary parties. 2.

The delay stands condoned, abatement is set aside and legal heirs of deceased claimant Vishwanath are permitted to be brought on record. Both parties are at liberty to carryout the amendment. 3.

The Civil Application is disposed of.
