Both the learned Counsel submit that this Court, vide order dated 23.01.2026 passed in Civil Application No.955/2026 in First Appeal (Stamp) No.26405/2022, permitted the Applicant to withdraw 75% of the amount along with accrued interest thereon, upon furnishing an undertaking that in case the Appeal goes against him, he will refund the amount. They further submit that 100% of the amount has been deposited before this Court. The Claimants, being aged about 70 and 78 years respectively, are not in a position to travel. Therefore, the amount permitted to be withdrawn needs to be transmitted to the Motor Accident Claim Tribunal, Beed. It is pointed out that the learned Counsel Mr. Wange has no objection to the same. 2.
In view thereof, 75% of the amount along with accrued interest thereon shall be transmitted to the Motor Accident Claim Tribunal, Beed. Civil Application is disposed of accordingly. [SIDDHESHWAR S. THOMBRE, J.] Sameer/February-2026
