This is an application for condonation of delay of 3794 days caused in filing the present application for restoration of the First Appeal on its original position.

Perused the application. Heard learned Advocate for the appellants and also learned AGP for respondent-State. 3.

Learned Advocate for the applicants submits that the applicants are farmers and they are unaware about the printing charges for paper book. Therefore the charges were not paid by the applicants and appeal is dismissed.

Considering the above submission and the reasons stated in the application as well as in view of the judgment of New Okhla Industrial Development Authority Vs. Rameshwar @ Ramesh Chandra

927-ca-2402-2026 -2Sharma, Civil Appeal Nos.8331-8345 of 2022, the application deserves to be allowed. Hence, the following order:

ORDER

a.

Civil Application is allowed.

b.

Delay of 3794 days caused in filing the present application is condoned.

c.

First Appeal be restored to its original position.

d.

Applicants shall not be entitled for the interest for the said period of delay.

e.

Civil Application is disposed of.
