The Vakalatnama of proposed legal representatives is filed and taken on record. Death certificate of applicant No.5.1 (Radheshyam) is dispensed with. As far as the name of Pramilabai is concerned, there is certificate issued by the Police Patil and Sarpanch that Pramila and Premala are one and the same person. Thus, all the office objections are complied with.
This application is filed for condonation of delay, setting aside abatement and permission to bring the legal representatives of deceased claimant Pramilabai on record, as mentioned in the title clause of the application.

On perusal of the application and reasons stated therein, it appears that the applicants hail from rural area and they were not knowing the procedure. They could not communicate the death of claimant Pramilabai to their advocate. Therefore, the delay is caused. The delay is not deliberately caused.
For the reasons stated in the application, the application deserves to be allowed as the delay is not caused deliberately and intentionally. Hence, the delay is condoned. Abatement is set aside. Permission is granted to bring the legal representatives of deceased claimant Pramilabai on record. Necessary amendment be carried out forthwith. The civil application stands disposed of. [ SANJAY A.
