The civil application No. 2582 of 2026 is filed seeking withdrawal of the amount. Perused the application. Heard learned advocates for both the sides. Learned advocate for the respondent MSRTC strongly opposed the application.

Considering the reasons stated in the application, the application deserves to be allowed partly. The application is thus allowed. The applicants are permitted to withdraw entire amount deposited till today, with accrued interest thereon, on furnishing usual undertaking to the satisfaction of Registrar (Judicial) of this Court. It is made clear that the share of original claimant No.2, who is now no more, be paid to applicant No.1 herein.

Learned advocate for the applicant pointed out the pursis dated 15.12.2025, in which it is submitted that respondent No.2 is dead. As per him, respondent No.1 Kavita Shankar is the only legal representative, whose name is already on record and therefore, it is not necessary to bring the legal representatives of respondent No.2 on record. Learned advocate for the appellant is directed to bracket the name of respondent No.2 within a week from today. 4.

Learned advocate for the appellant submitted that he may be permitted to file hard copy of the pursis on record till the next date. 5.
