Considering the averments made in the application, the Civil Application is allowed.

Insofar as prayer clause (B) is concerned, the same is allowed at the risk of the Petitioner.

WRIT PETITION NO.3512 OF 2022:- 3.

After hearing the learned Advocates for some time, both the learned Advocates submit that the present petition arises out of the order dated 05.08.2021 passed below Exhibit-135 by the learned Civil Judge, Junior Division, Kandhar in R.C.S. No.105 of 2011. They further submit that since 05.08.2021 the order of status quo is in operation. 4.

In view thereof, without going into the merits of the matter, I Tauseef

2 of 2 47-CA.2854.2026 am inclined to dispose of the present petition by directing the Trial Court to decide the suit itself within a period of six months from today. 5.

It is made clear that this Court has not continued the interim order on merits, the same is continued only in view of the fact that it has been in operation since 2021. The Trial Court shall decide the suit on its own merits, without being influenced by the continuation of the interim order.
