Despite service of notice, respondent No.3 chose to remain absent.

By this civil application, the applicant/petitioner is seeking protection to his service. This court, by an order dated 21.02.2025, has already protected the service of the petitioner. However, it seems that due to communication gap, interim order passed by this Court could not be serve on respondent No.3. It thus appears that due to said communication gap, respondent No.3 has issued letter dated 21.02.2026 by which services of the petitioner is sought to be brought to an end.

In that view of the matter, we are inclined to grant interim relief in terms of prayer clause (B) subject to petitioner filing an undertaking within a period of two weeks before this Court as well as before the employer, that pending this petition, the petitioner will not claim any service benefits such as promotion, increment, pay fixation and confirmation, etc. 5.

Civil Application No. 2901 of 2026 thus stands disposed of accordingly.

List the writ petition on 09.06.2026 for further consideration.
