During the pendency of the present proceedings, it is informed that the claimant by name Prakash has died and, therefore, application is preferred for bringing legal heirs on record. It is contended due to inadvertence, the LRS are not brought on record and consequently, delay of two years and 148 days has occurred. A request is made that the abatement may be set aside and legal representatives be allowed to be brought on record.

Prayer is not seriously opposed by the learned AGP and learned counsel for acquiring body.

In that view of the matter, Civil Application is allowed in terms of prayer clause 'B' and 'C'. Necessary amendment be carried out within a period of two weeks from today.
