Learned counsel for the applicants seek condonation of delay of 1383 days in setting aside abatement, and bringing legal heirs of deceased Sonaji Chandrabhan Jadhav on record. It is pointed out that the heirs have been shown as appellant in a separate appeal filed by them challenging self-same judgment and award which was filed earlier in time. The cause of action survives against heirs of deceased claimant. They are necessary parties. 2.

The delay is not intentional, its stand condoned. Abatement is set aside. Leave is granted to bring the legal heirs of the deceased claimant Sonaji Chandrabhan Jadhav on record. Parties would be at liberty to carry out the amendment.
