Present application is treated to be application for modification of the judgment and award dated 17th November, 2025 passed by this Court. Already First Appeal No. 1446 of 2022 was allowed, which was filed by the claimant and First Appeal No. 1684 of 2021 is dismissed, which was filed by the acquiring body.

Inadvertently the amount deposited by the acquiring body to the tune of 25% with accrued interest remained to be disbursed to the claimant.

Therefore, the application succeeds and clause No. (iv) of the operative part of the judgment dated 17.11.2025 needs to be modified by adding following sentence.

"The amount with accrued interest deposited at the instance of the acquiring body shall be disbursed to the claimants as per their entitlement".
