Learned counsel for the applicants points out that, the respondent-insurance company being aggrieved by the judgment and award dated 31.12.2012 in M.A.C.P. No. 72 of 2007 passed by

P1-CA-3285-2026 -2learned Member, M.A.C.T., Shahada, had preferred First Appeal No. 1114 of 2013 before this Court. However, before the Special Lok Adalat held on 01.12.2024 the respondent-insurance company accepted the award passed by the Tribunal and withdrew the First Appeal and the same accordingly stood disposed off in terms of withdrawal pursis.

Learned counsel further submits that the instant application is filed by the applicants-original claimants with a prayer to transmit the amount deposited in this Court, with interest accrued thereon, to the Motor Accident Claim Tribunal, Shahada for withdrawal. 4.

In view of the above submissions, the Civil Application is allowed in terms of prayer clause (B) and disposed off accordingly. [ABHAY S. WAGHWASE, J.] vre
