Heard Mr. Palod, the learned counsel appearing for the applicants and Mr. Gholap, the learned counsel appearing for the non-applicant, at length.

The parties to the present appeal are personally present in the Court.

By the present application, the applicants who are the plaintiffs in Special Civil Suit No.114 of 2012, put forth prayer clause (B), as under:- "[B] The Applicants may kindly be permitted to withdraw the Spl. Civil Suit No.114/12 and it may kindly be dismissed as withdrawn without any costs and First Appeal may kindly be allowed accordingly."

The learned counsel appearing for the non-applicant has raised no objection.

In view of above, Special Civil Suit No. 114 of 2012 is hereby dismissed as withdrawn. Resultantly, the impugned judgment and decree dated 06.09.2018, is hereby quashed and set aside. 6.

Accordingly, First Appeal No. 165, is hereby disposed off. 7.
