PER COURT :
The applicants are seeking modification of the order as due to supervening events confusion is created while directing them to receive the amount.

It transpires that applicants were permitted to receive the amount vide order dated 09.06.2025. The Acquiring Body was expected to deposit the entire amount and after depositing that amount the order dated 09.06.2025 was to be operated. However, instead of depositing entire amount , the Acquiring Body deposited only 50% of the amount with accrued interest. In view of this situation, the office did not permit the applicants to receive the amount in pursuance of the order dated 09.06.2025.

No fault can be attributable to the applicants. They are entitled to receive the amount but the lapses are on the part of the Acquiring Body. In view of the supervening events, it is desirable to permit the applicants to receive the amount deposited with accrued interest on furnishing undertaking.

The applicants shall be permitted to receive entire deposited amount with accrued interest on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court.

The Civil Applications are disposed of.
