By CA/7596/2025, applicant - Acquiring Body seeks condonation of 150 days delay. There is no mala fides in preferring the appeal belatedly.

For the reasons mentioned in the Civil Application No. 7596 of 2025, same is allowed. Delay stands condoned. 3.
The applicants seek to withdraw various amounts deposited by the Acquiring Body.

Learned counsel for the applicants has placed on record a common judgment dated 17.03.2026, to buttress that the claimants' appeal / s for the enhancement in identical situation, have been partly allowed by this Court. In the wake of the decision, the entire amount is sought to be withrawn.

Application is contested by the respondents.

Applicants come from Devgaon and / or adjoining villages. Their lands were acquired for percolation tank. Prima facie, I find similarity in the location and nature of the land. It would be appropriate to permit the applicants to withdraw amounts on undertaking only. 7.
I, therefore, pass the following order :-
ORDER
I) Civil Applications for withdrawal of amounts are allowed partly.
4 934 - 954 II) Applicants are permitted to withdraw 75% of the amount of compensation with accrued interest on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court and 25% amount with accrued interest on furnishing solvent surety / security to the satisfaction of the Registrar (Judicial) of this Court.
