Petitioners are contending that they acquired membership of respondent trust in the year 2016. They have paid membership fees and then the President and Secretary communicated them regarding acceptance of their membership. Mr. Deshmukh, would further contends that petitioners have also contributed in purchase of land for institution run by trust.

Learned advocates appearing for respondents, however, seriously dispute the authority of then President and Secretary to admit members or passing any resolution in this regard. 4.

Prima facie, there appears serious dispute as regards to validity of membership of the petitioner. True that petitioners have filed on record some documents showing their admission as a Member and payment of the membership fees, however, unless resolution admitting them as Member is placed on record and such authenticity of resolution is tested by competent authority, this Court cannot delve into validity of the petitioners membership.

In that view of the matter, writ petition stands disposed of with liberty in favour of the petitioners to raise the issue as to denial of their membership at appropriate stage before the appropriate authority. Pending civil application, if any, also stands disposed of.
