Applicants seek to condone delay of 315 and 288 days in preferring respective appeals. The contents of the applications have not been controverted. There is no reason to infer any malafides on the part of the acquiring body. The delay is condoned.

Applicant seeks to withdraw amount of Rs.10,48,261/- deposited by the respondent/acquiring body.

In similarly situated matters, this Court permitted the claimants to receive 75% of the amount with accrued interest on furnishing undertaking. I propose to follow the same course.

Application is allowed partly permitting the applicant to receive 75% amount with accrued interest on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court.

7.

Balance amount shall be invested in any nationalize bank.

Civil Applications for Stay 8.

As the amount has been deposited in pursuance of the orders passed by this Court, ad-interim relief shall stand confirmed.
