Applicant seeks to withdraw amount of Rs.63,91,240/- deposited by the respondent/acquiring body.

It reveals from the record that the enhancement granted by the Reference Court is almost equal to four times. The acquiring body is Corporation. I find that the interest would be sub-served in permitting the applicant to receive 80% amount on furnishing undertaking.

Civil application is allowed partly permitting the applicant to receive 80% amount with accrued interest on furnishing undertaking.
