VERSUS

The Chief Officer, Muncipal Council, Degloor, Nanded ...

Advocate for Applicant : Mr. Ravibhushan P. Adgaonkar ...

WITH ARBAST/11054/2026 ...

CORAM : ARUN R. PEDNEKER, J.

Dated : April 23, 2026 PER COURT :

1.

In Civil Application No. 4416 of 2026, filed for condonation of delay of 16 days in filing the Arbitration Appeal, for the reasons stated in the application, the same is allowed and disposed of. 2.

The present Arbitration Appeal is filed by the original claimant - MD Engineers, challenging the award to the limited extent of grant of interest at the rate of 6% per annum and seeking enhancement thereof. 3.

The learned Counsel for the appellant has submitted that the rate of interest awarded by the Arbitral Tribunal is on the lower side and deserves to be enhanced.

4.

However, the scope of interference under Section 34 and Section 37 of the Arbitration and Conciliation Act, 1996 is limited. The Court cannot modify or enhance the rate of interest awarded by the Arbitrator Page 1 of

In view of the above, no case is made out for interference with the arbitral award on the aspect of interest. Accordingly, the Arbitration Appeal (Stamp) No.11054 of 2026 stands dismissed.
