The learned Counsel for the applicant submits that the applicant was reinstated on 18/09/2012 and retired on superannuation on 29/02/2024. As such, in the present writ petition, the only issue that survives is with regard to back wages for the period from 25/03/2011 to 18/09/2012. 2.

The applicant is willing to waive the said back wages, provided that the yearly increments for the said period and continuity of service for the purposes of pension and pay fixation are granted by the respondents. It is further submitted that, upon granting the aforesaid increments and consequential benefits, the pension proposal of the applicant be submitted before the competent authority.

936 CA 4439-2026 petitioner has no objection to forwarding the proposal. 4.

Considering the submissions, the petition is disposed of with a direction that the petitioner shall submit the pension proposal of the applicant, along with all consequential benefits, to the Education Officer within a period of four weeks. The Education Officer shall take a decision on the said proposal within a period of eight weeks thereafter. 5.

The Civil Application so also the Writ Petition are disposed of accordingly.
