The learned counsel for the petitioners submits a joint pursis, which is taken on record and marked "X" for identification. It is stated therein that the parties have amicably settled the dispute. The petitioners have agreed to provide a cart way. The terms of the joint pursis read thus: "The petitioners, respondent No. 3 in present writ petition and other intervention applicants in Civil Application No. 4781/2026 respectfully submits as under:

That, the parties have settle the dispute amicably and arrived as settlement as under;

That, the petitioners are ready to provide cart way, from the starting point for construction of the cart way will be from Sominath Temple situated at Gaothan. The said cart way would be made in Gut no. 266 which is owned by the petitioners, by the boundary adjacent to Gut No. 70 and same would be touches to the existing road at AAi Mandir (Mal) of Village Waghrul Dongargaon, Tq. Badnapur, Dist: Jalna. This cart way is accepted by the

Dilwale 2 909-WP-2903-21.odt respondent No. 3 and interveners.

Hence this Joint Pursis."

In view of the aforesaid joint pursis, the present petition stands disposed of. It is made clear that, since the parties have arrived at an amicable settlement, the same shall be binding on all the parties. The Intervention Application stands allowed.
