Heard learned counsel for the Applicant and perused the impugned judgment, order, and record.

Learned counsel for the Applicant/Appellant submits that the Applicant has already deposited the compensation amount of 7,36,680/- ₹ before the learned Trial Court. However, the interest component thereon has not yet been deposited. It is further submitted that the claimants failed to establish the employer-employee relationship, and no cogent material has been brought on record in that regard. Learned counsel further submits that the deceased admittedly died due to a heart attack and, therefore, according to the Applicant, the claimants were not entitled to compensation. 1.CA.5506.2026.odt the learned Trial Court, upon appreciation of the evidence available on record, has recorded a finding that the deceased was employed with Respondent No.1 through Respondent No.2 and consequently held the claimants entitled to compensation.

Having considered the submissions advanced and upon perusal of the material on record, I deem it appropriate to stay the impugned judgment and order, subject to the Applicant depositing the interest amount accrued on the compensation amount before the learned Trial Court within a period of six weeks from today.

Hence, the following order.

O R D E R

(A) The Application is allowed in terms of the prayer clause (b). (B) The execution and operation of the impugned Judgment and Order shall remain stayed, subject to the Applicant depositing the interest amount on the compensation awarded before the learned Trial Court within a period of six weeks from today.

(C) In the event of failure to deposit the aforesaid amount within the stipulated period, this order shall stand vacated automatically without further reference to the Court. (ABHAY J. MANTRI, J.) Shrikant Malani
