The present Contempt Petition has been filed by the Petitioner alleging disobedience of order dated 27th November, 2025 passed by the learned Judge, Family Court No.2, Mumbai below Exhibit-43 in Petition No.A-2534 of 2021. The operative part of the said order dated 27th November 2025 read as under:- "ORDER 1.

The application vide Exhi.43 is hereby allowed. 2.

Respondent is hereby directed to remain present before the competent authority for renewal of passport/OCI cards and cooperate for the compliance of the procedure."

The learned counsel appearing for the Respondents has raised the contention that the Petitioner will misuse the passport to be issued in favour of the daughter, to permanently relocate the minor daughter. 3.

In view of the said contention raised by the learned counsel appearing for the Respondent, the Petitioner has tendered affidavit dated 20th February, 2026. Paragraph No.3 of said affidavit is relevant, which read as under.

"3.

I hereby voluntarily state and undertake to this Hon'ble Court that, I shall retain my daughter, Ms. Nandini Chatterjee, aged about 13 years, in Dhirubhai Ambani International School, Bandra East, Mumbai 400 051, till she finishes schooling. The Petitioner will not relocate her permanently elsewhere in India or outside India, in any other boarding school." 4.

In view of the said affidavit learned counsel for the Respondent states that the Respondent will render complete cooperation for renewal of the Passport/ OCI cards of the minor and will comply with the order dated 27th November 2025 passed by the learned Judge, Family Court No.2, Mumbai.

Both the learned counsel tender Minutes of Order which are signed by respective parties as also respective Advocates. The said Minutes of Order read as under:-

The various statements made in the Minutes of Order which are also signed by the respective parties are accepted as undertakings given to the Court.

It is required to be noted that the Respondent has stated that he will comply with the order dated 27th November, 2025 passed by the learned Judge, Family Court No.2, Mumbai below Exhibit-43 in Petition No.A-2534 of 2021.

Thus, by accepting the statements made in the "Minutes of Order" as undertaking given to this Court, the Contempt Petition is disposed of. ( MADHAV J. JAMDAR, J.)
