DATE : 17 MARCH, 2026 P.C. :- 1) By the present transfer application, the applicant, wife of the respondent is seeking transfer of the divorce proceeding filed by the respondent-husband before the Civil Judge Senior Division, Kalyan, District Thane to the Family Court at Beed. 2) It is the case of the applicant that she has been residing with her parents' house at Beed for last one year and she cannot travel to Kalyan Court to attend the Court proceeding which is around 430 kms away. He further submits that the respondent is Assistant Civil Engineer in PWD Department.
3) Learned advocate appearing for the respondent on
2/3 instructions of the respondent submits that he has no objections if the proceeding pending before the Civil Judge Senior Division, Kalyan, District Thane is transferred to the Family Court at Beed. 4) In view of the statement made by the learned advocate appearing for the respondent, the present miscellaneous civil application stands allowed in terms of prayer clause (b). 5) The respondent-husband is permitted to attend the Court proceedings by video conferencing before the Family Court at Beed. However, whenever necessary, as per the directions of the learned Family Court at Beed, taking up the matter, the respondent will have to attend the proceedings in person.
6) Learned counsel for the applicant is hereby directed to convey the order passed today to Civil Judge Senior Division, Kalyan, District Thane who is hearing the proceedings. 7) Similarly, Registrar (Judicial-I) is hereby directed to communicate the order passed today to the Registrar of the Civil Judge Senior Division, Kalyan, District Thane by E-mail. 8) The Hindu Marriage Petition No. 1797 of 2025 pending before the Civil Judge Senior Division, Kalyan, District Thane be transferred within four weeks to the Family Court at Beed. 9) At this stage, both the learned advocates submit that the
3/3 dispute be referred to the mediation as the applicant and the respondent are relatively young people and they have a long life ahead.
10) In view of the same, the learned advocates are free to refer the matter to the Mediation Centre of Family Court at Beed. [RAJESH S. PATIL, J.]
