1) The present transfer application is filed by the applicant-wife of the respondent, seeking transfer of the respondent-husband's divorce petition filed before the Family Court at Kolhapur to the Family Court at Pune.

2) It is the case of the applicant that she is staying at Pune and is conducting classes for Specially Abled Children and the classes run from morning to evening. Therefore, it is inconvenient for her to travel to attend the court proceedings at Kolhapur, and she is staying in a premises which is on leave and licence at Pune. The distance between Pune and Kolhapur is around 250 kms. She further submits

Diksha Rane 907 MCA 82 2026.doc that the respondent is not paying any maintenance to the applicant. 3) Mr. Kasar, learned counsel appearing for the respondent, opposed the application on the ground that although the applicant is residing in Pune and conducting tuition classes, she is not engaged in teaching specially abled children. Therefore, it is reasonably possible for the applicant to attend court proceedings at Kolhapur. On the other hand, the respondent's father is suffering from paralysis, and consequently, it would be difficult for the respondent to attend court proceedings at Pune.

4) The statement made by Mr. Kasar, learned counsel appearing for the respondent has been opposed by Ms. Kirthika K., learned counsel appearing for the applicant.

5) Having heard learned counsel for both sides, in my view, this M.C.A. can be allowed with certain directions to both parties. 6) M.C.A. stands allowed in terms of prayer clause (A). 6.1) The proceeding of Petition No.A/26/2025 pending before the Family Court, Kolhapur be transferred to the Family Court, Pune, within a period of four weeks from today.

6.2) The order dated 4/4/2026 passed by the Family Court, Kolhapur in Petition No.A/26/2025 is by consent set aside.

Diksha Rane 907 MCA 82 2026.doc 7) The applicant would file her written statement/say to Petition No.A/26/2025 within a period of six weeks from today. 8) The applicant is permitted to prefer application before the Family Court, Pune to take her written statement/say on record. 9) Once the proceedings are transferred to the Family Court, Pune, hearing of the divorce proceeding is hereby expedited and learned Judge taking up the matter before the Family Court will make an attempt to try and dispose of the divorce proceedings within a period of 15 months from today.

10) Both the parties undertake that they will co-operate with the Family Court, Pune and they will not seek unnecessary adjournment before the Family Court at Pune.

11) The respondent-husband is permitted to attend the proceeding before the Family Court at Pune through video conferencing. However, whenever necessary, as per the directions of the learned Judge taking up the matter, the respondent will have to attend the proceedings physically in Court.

12) Learned counsel for the applicant is hereby permitted to convey the order passed today to the Family Court, Kolhapur.
