1) This transfer application preferred by the applicants on the ground that two separate suit were filed in the High Court seeking a declaration of the Gift Deed and the Lease Deed as void-ab-initio. One suit for declaration of the Lease Deed to be declared as void-abinitio, has been transferred to the City Civil Court pursuant to the enhancement of the pecuniary jurisdiction of the City Civil Court, Bombay. She submits that the respondents have been duly served. 2) Mr. Harshal Dilip Patel - respondent no.4, had appeared in person and submits that he has engaged service of advocate Mr. Sundar Bhandari. Due to personal difficulty of the advocate, he is not able to come today to Court. He submits that he would like to file reply to the present transfer application.
