1) This transfer application has been filed by the applicant, wife of the respondent no.1 seeking transfer of her own domestic violence proceeding pending before the Metropolitan Magistrate Court at Borivali to the Family Court at Bandra where she has filed the divorce proceedings.

2) I have heard learned counsel for both sides.

3) Learned counsel appearing for the respondent has no objection if the domestic violence proceeding of the applicant is transferred to the Family Court at Bandra and to be heard along with divorce proceedings, provided respondent nos. 2 to 5 are permitted to appear through video conferencing in the domestic violence proceedings.

Diksha Rane 11 MCA 136 2026.doc 4) In view of the statement made by learned counsel appearing for the respondents, on instructions of the respondents, MCA stands allowed in terms of prayer clause (a).

4.1) The Complaint - C.C. No.336/DV/2022 pending before 68th Court of Metropolitan Magistrate, Borivali, Mumbai be transferred within a period four weeks from today to the Family Court at Bandra, Mumbai.

4.2) The respondent nos. 2 to 5 are permitted to attend the proceeding before the Family Court at Bandra through video conferencing. However, whenever necessary, as per the directions of the learned Judge taking up the matter, the respondent nos. 2 to 5 will have to attend the proceedings in person. 5) Learned counsel for the applicant is hereby permitted to convey the order passed today to the 68th Metropolitan Magistrate Court at Borivali.

6) Similarly, Registrar (Judicial-I) is hereby directed to communicate the order passed today to the Registrar of the 68th Metropolitan Magistrate Court at Borivali, by E-mail. 7) MCA stands disposed of accordingly.
