CORAM:

SOMASEKHAR SUNDARESAN, J.

DATE:

MAY 5, 2026 ORDER :

1.

Liberty is granted to file a reply to this Petition, which essentially challenges an order passed under Section 9 of the Arbitration and Conciliation Act, 1996. The grievance is primarily centred around the dates on which the order is dated and has been uploaded, with the allegation being that the order is backdated. The Respondent must be permitted to file a reply setting out his perspective of facts.

2.

Let such reply be filed within a period of three weeks from today. Rejoinder, if any, shall be filed within a period of one week thereafter. Stand over to June 12, 2026.

Meanwhile, it is made clear that there is no intervention in the Impugned Order, because whether or not to vary, modify, alter or enhance interlocutory relief granted under Section 9 of the Act, squarely falls in the domain of the Learned Arbitral Tribunal, which is already in session. 4.

It is entirely up to the learned Arbitral Tribunal to factor in such facets as it considers necessary to fashion the interlocutory arrangements that have been made by the Impugned Order, and the parties are liberty to address the Learned Arbitral Tribunal in this regard despite the pendency of this challenge.

5.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website. [ SOMASEKHAR SUNDARESAN, J.] MAY 5 , 2026 Rutuja Borse
