After the matter was argued at some length and the Court had expressed its disinclination to interfere with the impugned order, Mr. Jha, learned counsel for the Appellants did not press the Appeal and submitted that the Appeal may be disposed of with a clarification that the learned Arbitrator shall decide the Section 17 application without being influenced by the observations made in the impugned order.

Hence, I pass the following order:

(i) Needless to state the learned Arbitrator shall decide the Section 17 application independently and without being influenced by the observations made in the impugned order.
