1. Learned Advocate for the Respondents makes a statement that the Respondent No.2 has expired. Leave granted to amend the cause-title to record the demise of Respondent No.2 and to incorporate the name of the sole legal representative of Respondent No.2 in the cause-title.

3. The Applicant has filed an objection dated 18.12.2025 before the Senior Town Planner, Margao, objecting to the grant of regularisation of the structure, which is the subject matter of Execution 16th January, 2026

MCA 24 of 2026 Proceedings No. REXA/16/2023/A before the Civil Judge Senior Division at Margao. These objections were considered by the Senior Town Planner on 29.12.2025, and the matter has now been listed on 10.02.2026.

It is the contention of the Applicant that the Applicant's Expert should be permitted to inspect the suit flat and to assist the Applicant to file additional objections before the Town and Country Planning Department.

Considering that the Senior Town Planner is seized of the matter, and had granted the request, it is open for the Town Planner, if he finds the need to inspect the premises, to collect the keys of the premises from the Registry of the Court of Civil Judge Senior Division 'A' Court, Margao, to inspect the flat and return the keys to the said Registry. If the Senior Town Planner so opines, he shall, under the cover of a letter to the Court of Civil Judge Senior Division 'A' Court, Margao, request the keys of the premises and return the same to the Court after such inspection is conducted. With these observations, the application stands disposed of.

5. A copy of this Order shall be placed on the record of the Civil Court dealing with the Execution Proceedings No.REXA/16/2018/A. VALMIKI MENEZES, J.
