The learned counsel for the applicant has stated that as the non-applicant is residing out of India, the service by private mode is completed at the instance of the applicant. So also served the copy alongwith message through Whatsapp which shows the blue-tick of receipt of the same by the non-applicant.

In the present matter, Non-Applicant being resident of out of country, one more opportunity is required to be granted to him. However, if there is no response from Non-Applicant till next date, then considering the fact that he being served, this court may proceed further in the matter.
