CORAM : ANIL S. KILOR AND RAJ D. WAKODE, JJ. DATE : 12.01.2026 This is an application for review on the ground that behind the back the order dated 10.12.2025 came to be passed.

On perusal of the order dated 10.12.2025, we are of the opinion that the order is not adverse. It appears from the said order that a communication dated 21.05.2025 issued by the Executive Magistrate, Tumsar to Police Station Officer, Tumsar, which was not taken to its logical end by the Police Station Officer and therefore, simple directions were issued to take such communication to its logical conclusion.

If the petitioner is aggrieved by such communication dated 21.05.2025, he may take steps to file appropriate proceeding raising a challenge to such communication, however, since the said order dated 10.12.2025 doesn't appear to be against the petitioner, the review petition cannot be entertained.

The applicant in the above referred backdrop seeks permission to withdraw the present application for review with liberty to file an appropriate proceeding before the appropriate Court raising a challenge to the communication dated 21.05.2025 issued by the Executive Magistrate, Tumsar, 5.

Permission to withdraw the present application is granted with liberty as prayed for. 6.

Accordingly, the miscellaneous civil application is disposed of as withdrawn with liberty as prayed for.
