Despite due service, the respondent remained absent and, therefore, this Court proceeded ex parte against the respondent. Subsequently, the applicant-NMC, Amravati (original respondent), entered appearance and filed an application seeking review under Section 115 of the Code of Civil Procedure, along with a prayer for recalling the order dated 22.12.2025 by invoking Section 151 of the Code of Civil Procedure, 1908.

During the course of hearing, learned counsel for the applicant-NMC, Amravati submitted that the application is not being pressed in its entirety and is restricted only to the prayer for recalling the ex

parte order dated 22.12.2025. He further, on instructions, stated that the applicant has no objection to the appointment of an Arbitrator for resolution of the dispute between the parties.

All civil applications stand disposed of.
