The applicant/wife has filed the present application seeking transfer of Hindu Marriage Petition (HMP) No.121 of 2024 from the file of the learned Civil Judge, Senior Division, Saoner to the file of learned Joint Civil Judge, Senior Division, Gondia.

It is not in dispute that the applicant/wife has filed a petition for restitution of conjugal rights before the Court of the learned Civil Judge, Senior Division, Gondia being HMP No.204 of 2025. Both proceedings are pending at the stage of framing issues. It is expedient that both proceedings for restitution and divorce are decided by the same Court.

The applicant is staying with a three year old child.

In view of the above, application is allowed. HMP No.121 of 2024 is transferred from the file of the learned Civil Judge, Senior Division, Saoner to the file of learned Joint Civil Judge, Senior Division, Gondia.
