The learned Counsel for Applicant submits that distance between Nagpur to Nashik is around 650 to 680 kms. As such, it is difficult for the Applicant to travel such a long distance. So also she stated that Applicant is not getting any maintenance from the Non-applicant in any matter, and therefore, she is facing financial crisis. As such, she could not bear the travelling charges for attending the proceeding at Nashik and engage the Counsel at Nashik. Hence, she seeks indulgence of this Court in the matter and requested to transfer the proceeding bearing Petition B.No. 4/2025 pending on the file of Family Court, Nashik to Family Court, Nagpur.

Issue notice to the Non-applicant, returnable after four weeks.

It is pointed that the matter is fixed for filing written statement of the Applicant before the Family Court, Nashik on 6th February, 2026 and there is likelihood of passing exparte order against the Applicant.

In view thereof, there shall be ad-interim stay in terms of prayer clause - (ii) of the Application.

In addition to regular mode of service, the Applicant is permitted to serve the Non-applicant by all modes of private service as permissible in Rules and file affidavit of service on or before the next date, failing which, stay granted will be vacated automatically.
