2) This is an application filed by the applicant/wife seeking transfer of divorce petition E-16/2024, filed by her husband/respondent from the Family Court at Amravati to the Court of Civil Judge Senior Division, Yavatmal. The wife has filed petition for restitution of conjugal right before the Court at Yavatmal, which is registered as H.M.P. No.103/2018. 3) The daughter of parties, who is presently around 11 years is residing with the applicant/wife. The distance between Amravati to Yavatmal is around 100 k.m. In order to rule out any possibility of conflicting decrees in the restitution and divorce petitions, and having regard to the fact that the wife is residing with a minor daughter, it would be expedient to transfer the divorce petition filed by the respondent-husband to the Court at Yavatmal, where the restitution proceedings are pending. Since the restitution and divorce proceedings are to be contested at Yavatmal, the petition under Section 125 filed by the wife KOLHE
2 12-mca 110.2026.odt should also be transferred from Amravati to Yavatmal. The application is allowed in the following terms :- (1) The petitions bearing No.A-273/2021 and E-16/2024 are ordered to be transferred from the file of Family Court, Amravati to the Court of Civil Judge Senior Division, Yavatmal.
(2) In the event the respondent/husband makes an application for appearance through video-conferencing, the same may be considered favourably and permission to appear through video-conferencing may be granted on such dates and at such stages as is deemed appropriate by the learned Court of Civil Judge Senior Division, Yavatmal.
