The applicant has submitted that she has already initiated proceedings under the Protection of Women from Domestic Violence Act, 2005, bearing PWDVA Case No. 13 of 2025, before the learned Judicial Magistrate First Class, Hinganghat. It is further submitted that, as a counterblast to the said proceedings, the non-applicant has filed divorce proceedings at Chandrapur. The applicant has also stated that she has a three-year-old child. In these circumstances, issue notice to the non-applicant, returnable after four weeks.

It is pointed out that the next date before the learned Civil Judge Senior Division, Chandrapur, is 27.02.2026 to proceed exparte against the present applicant.

In the meantime, there shall be stay in terms of prayer Clause-(ii) till next date.

The applicant is permitted to serve the nonapplicant by all permissible private mode of service in addition to regular mode of service and file the affidavit to that effect.
