By this application, the applicant/wife prays for transfer of Hindu Marriage Petition No.544/2025 from the file of Civil Judge, Senior Division, Chandrapur to the Court of learned Civil Judge, Senior Division, Hinganghat. 2.
The distance between Hinganghat to Chandrapur is around 90 kilometers. The applicant/wife has custody of three years old minor child of the parties. Apart from this, the applicant/wife has filed proceeding under the Protection of Women from Domestic Violence Act, 2005 bearing PWDVA Application No.13/2025 before the Court of learned Judicial Magistrate First Class, Hinganghat.

The respondent/husband has opposed the prayer. He contends that his brother is a specially abled person and his father is also not keeping well. He has filed documentary evidence in support of his contention.

Both sides have genuine difficulty in prosecuting the proceeding at the place of residence of the other side.

MCA 118 of 2026.odt However, having regard to the fact that the minor daughter of the parties is staying with the applicant/wife and also having regard to the fact that one proceeding, which is filed prior in point of time is pending at Hinganghat, I am inclined to allow the application for transfer of proceeding. It must also be stated that although difficulty expressed by the respondent/husband appears to be genuine difficulty, he does not stay at home round the clock to take care of his brother and father since he has to work to earn a living. 5.
In view of aforesaid, Misc. Civil Application is allowed. Hindu Marriage Petition No.544/2025 is ordered to be transferred from the file of learned Civil Judge, Senior Division, Chandrapur to the Court of learned Civil Judge, Senior Division, Hinganghat.

In the event, the respondent/husband makes an application for appearance through Video-Conferencing, the same may be considered favourably and permission to appear through Video-Conferencing may be granted on such dates and at such stages, as is deemed appropriate by the learned Civil Judge, Senior Division, Hinganghat.
