IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

NAGPUR BENCH : NAGPUR.

MISC. CIVIL APPLICATION (REVIEW) NO. 213 OF 2026 IN WRIT PETITION NO. 2030 0F 2026 Ravi Dulichand Joshi vs.

Tahsildar, Kalmeshwar, Dist. Nagpur and anr.

------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order ------------------------------------------------------------------------------------------------------- Mr. A. C. Dharmadhikari, Advocate for applicant. CORAM :- ANIL S. KILOR and RAJ D. WAKODE, JJ. DATE :- 2nd APRIL, 2026.

Heard Mr. Dharmadhikari, the learned counsel for the applicant. 2.

This is an application for recalling of the order dated 11.03.2026 passed in Writ Petition No.2030 of 2026.

3.

When we perused the order, we are surprised that how such application can be filed, particularly when there is not a single observation against the applicant recorded on merits except the directions to the Sub-Divisional Officer (SDO) to decide the appeal, which is pending before the SDO.

4.

The argument of the learned counsel for the applicant is that, this Court may see the conduct of the petitioner.

5.

We do not find favour with the aforesaid argument for the reason that the said appeal is pending before the SDO and we simply asked the SDO to decide the appeal wherein the applicant is also a party. In absence of any findings on merits or observations against the applicant, or anything to show that a prejudice is caused to the applicant, the filing of the present application cannot be appreciated. 6.

Accordingly the Misc. Civil Application is dismissed. 7.

Needless to mention that the parties are at liberty to raise all the grounds as available in law before the SDO in appeal. ( RAJ D. WAKODE, J.) (ANIL S. KILOR, J.) Andurkar.
