In the earlier round of litigation, at the behest of the present petitioner, in Writ petition No. 8379 of 2025 (Surendra Kumar Ramsewak Yadav .v/s. Union of India and others) the following order was passed:

"Heard learned counsel for the petitioner.

2. In short, it is the case of the petitioner that he is subjected to departmental enquiry but the charges cannot be levelled against him. He therefore, preferred an application which is at page 45 dated 3.12.2025 for dropping of certain charges. According to him, the application dated 3.12.2025 has not been decided.

Be that as it may, since the application is preferred on 3.12.2025 and till this date, no action has been taken on the said application by respondent No. 3, we direct respondent No. 3 to decide the application dated 3.12.2025, in accordance with law, within twelve weeks from production of copy of this order. Petitioner undertakes to produce copy of this

118.wp.103.2026.odt order before respondent No.3, within a week. Petition is disposed of.

Mr. M. P. Kariya, learned counsel for the petitioner submits that this Court has directed the respondents to decide the representation made by the petitioner dated 03.12.2025 within a period of 12 weeks from the production of the copy of the said order. However, respondents, without deciding the aforesaid representation dated 03.12.2025, had issued the suspension order on 26.12.2025.

Mr C. J. Dhumane, learned counsel appearing for respondent Nos. 1 to 5 makes a statement, upon instructions, that the respondents will take decision upon the above representation as directed by this Court vide order dated 24.12.2025 in Writ Petition No. 8379 of 2025. The statement is accepted.

Thus, the respondents are accordingly directed to take decision on the above representation and are granted liberty to take further action after deciding such representation.

Accordingly, nothing survives in the present writ petition. The writ petition stands disposed of. No order as to costs.
