The petitioner's challenge is to the order passed by the trial Court, rejecting the application for framing of additional issues in the proceedings for grant of legal heirship certificate. 3.
Learned Counsel for the petitioner submits that the petitioner has filed a separate civil suit bearing Regular Civil Suit No.383/2025, in which the controversy with respect to the rights about the property in question would be adjudicated. Despite this, the trial Court has rendered the finding that there are no complications with respect to the heirs existing between the parties to the said proceedings. He therefore submits that the issues proposed to be framed particularly issue nos.3 and 4 was relevant in view of the controversy involved about the rights of the parties.

In view of this, issue notice to the respondents, returnable after four weeks.

In the meantime, ad-interim relief in terms of prayer clause (ii) shall operate, which reads as under :-
