The petitioner has approached this Court with following prayers:

"A) Writ Petition may kindly be allowed.

B) This Hon'ble court by issuing writ of certiorari or any appropriate writ, order or direction in like nature, impugned revise pay fixation order passed by the Res. No. 3 may kindly be quash and set aside. C) This Hon'ble court by issuing writ of mandamus or any other appropriate writ, order or direction in like nature the respondent No. 2 to 5 may kindly be directed to refund recovered amount of Rs. 5,09532/- to the petitioner with 12% interest from the date of retirement of the petitioner and pay all the consequential retirement benefit to the petitioner. D) Pending hearing and final disposal of this Writ petition the Res. No. 2 to 5 may kindly be directed to refund recovered amount of Rs.

5,09532/- to the petitioner.

E) To grant ad-interim relief prayer clause "D"

F) To grant any other Suitable relief in favor of the petitioners and entitled by him as per the law."

Learned Additional Government Pleader for the State submits that the petitioner is an employee of State and thus, the remedy for the aforesaid reliefs lies before the learned Maharashtra Administrative Tribunal, Nagpur. 4.

Accordingly, the writ petition is disposed of, with liberty to the petitioner to approach the learned Maharashtra Administrative Tribunal for the aforesaid reliefs. No order as to costs.
