Heard. Amongst three bidders, the first two bidders are the son and father having same office with shared machinery and persons and thus is labelled as case of cartelization. The petitioner's bid is rejected on technical grounds. 2.

Mr. Anand Jaiswal, learned Senior Counsel for the petitioner submits that the petitioner has been orally informed that his bid was rejected as he did not complete the work of Rs. One Crore for each year, specifically for the years 2022-2023, 2023-2024 and 2024-2025. Argument is that as per clauses of tender particularly clause (3-j), the bidder is required to complete the work of one crore in three years and not work of one crore each. We have gone through clause (3-j) and prima facie find substance in what is submitted by the petitioner. SKNair

Mr. Kasat, learned counsel appearing for respondent nos. 1 to 3, submits that, upon proper reading, the clause indicates that the bidder is required to complete work of Rs. One Crore in each year. We will test this submission in due course.

Issue notice to the respondents, returnable on 29.01.2026. 5.

Till then, the respondent nos. 1 to 3 shall not issue work order. 6.

In addition to usual mode, the petitioner shall serve respondent nos. 4 and 5 all permissible modes, including service by Speed Post and shall file an affidavit of service on record.
