The petitioner has approached this Court seeking direction to the respondent to grant compassionate appointment to the petitioner in accordance with Appendix 'G' of the Maharashtra State Electricity Distribution Company Limited, Classification and Recruitment Regulations, 2005 (for short, 'the Regulations of 2005'). The father of the petitioner, who was serving as a Junior Technician with the respondent, died in harness on 19.12.1987. Upon his death, the mother of the petitioner immediately applied for grant of compassionate appointment on 01.02.1988. However, compassionate appointment could not be granted to the

2 / 3 125.wp326.2026 mother of the petitioner and she became overage. The petitioner, who was a minor at the time of death of his father in the year 1987, attained majority in the year 2004. 3.

However, the petitioner on the ground of death of his father, the sole bread earner in the family, and the overage of his mother not being entitled for the appointment on compassionate basis, submitted the application on 05.10.2020 for grant of appointment on compassionate basis, which is at record page 30 (Annexure IV).

The said application was rejected by the Executive Engineer, MSEDCL, Saoner Division, vide communication dated 25.11.2020 on the ground that the said application was belated and was presented after 17 years.

Ms. Kolhe, learned counsel for the petitioner submits that the petitioner after the rejection of the aforesaid application had submitted a representation to the respondent for consideration of the case of the petitioner on sympathetic ground and in view of Rule 5, Note 3 of the APPENDIX 'G' of the Regulations of 2005 of the respondent-MSEDCL. She also submits that the application of the petitioner was belated then as per the Regulations of 2005, the Executive Engineer, should have

3 / 3 125.wp326.2026 forwarded the aforesaid application to the higher authorities for its decision.

Be that as it may, the petitioner has now approached the learned respondent Chairman and Managing Director, MSEDCL, Saoner for decision on his application dated 12.09.2022 which is at record page 74 (Anenxure X) and application dated 30.11.2022 which is on record at page 74 (Annexure X).

In view of the above, we dispose of the present writ petition with a direction to the respondent to decide the aforesaid application within a stipulated period of eight weeks from the date of receipt of this order and in the light of the Regulations of 2005, which are placed on record at Page 16 (Annexure I); more particularly, Note 3 of Clause (5).

The decision taken thereupon shall be communicated to the petitioner within a period of two weeks thereafter.

Writ petition is accordingly disposed of. No costs.
