The petitioner seeks challenge to the impugned judgment dated 20.01.2022 passed by the learned Maharashtra Administrative Tribunal, Nagpur Bench, Nagpur in Original Application No.53/2015. 3.

The contention is that the petitioner had challenged the impugned order dated 02.01.2014 thereby accepting the resignation of the petitioner and thus, retiring him from his service.

Mr. Gandhe, learned counsel for the petitioner submits that the applicant had challenged the aforesaid order dated 02.01.2014, so that, he can be allowed to rejoin his post and while on duty he shall be declared as medically unfit and permitted to avail the voluntary retirement.

The perusal of the judgment of the learned Tribunal shows that the petitioner on his own had submitted the application of his resignation. 6.

The request of the petitioner was considered by the respondents, however, directed him to deposit an amount equal to the basic pay of one month vide communication dated 05.12.2013. The petitioner had deposited the amount on his own equal to the basic pay of one month and had submitted the challan on 11.12.2023. The petitioner again submitted resignation on 16.12.2023, after submitting the aforesaid challan.

In view of above, the respondent No.1 had accepted the resignation of the petitioner vide order dated 02.01.2014 with effect from 11.12.2013. Thus, the petitioner has not disputed the aforesaid facts of submitting the application for resignation by depositing the amount of one month basic pay by challan dated

3 / 3 126.wp327.2026 11.12.2023 and passing of the order on 02.01.2014 thereby accepting the resignation of the petitioner.

In view of above, there is no merit in the submission of the applicant that the learned Tribunal has committed an error in not setting aside the order dated 02.01.2014 which was passed at the behest and after the compliance made by the petitioner.

In view of above, we dismiss the present writ petition. No costs.
