The petitioner's challenge is to the order dated 16.01.2026, passed by respondent No.1 Assistant Charity Commissioner-II, Nagpur, rejecting the application for ad-interim ex-parte relief to stay the elections to be held for respondent No.14 Trust, which are scheduled to be held according to the election programme mentioning the date of voting, scheduled for 18.01.2026 i.e. tomorrow.

Issue notice to the respondents, returnable on 22nd January 2026.

Learned AGP waives service of notice on behalf of respondent No.1-State.

The petitioner is permitted to serve the other respondents by private mode, in addition to regular mode of service and file affidavit of service in that regard by next date.

Having regard to the contentions canvassed, particularly considering the pendency of the application under Section 41-A of the Maharashtra Public Trusts Act, it is directed that the elections under challenge shall be subject to the result of proceedings under Section 41-A of the Maharashtra Public Trusts Act, pending before respondent No.1.
