The submission is that the petitioners have filed the revision before the respondent No.2- the Additional Commissioner, Nagpur under Section 257 of the Maharashtra Land Revenue Code, 1966 (for short 'the MLR Code') challenging the order dated 31.10.2014 passed by respondent No. 3 Additional Collector, Bhandara. However, in preferring the aforesaid revision there is a delay of more than five years and hence, in view of the proviso to the Section 257(1) of the MLR Code, the respondent No.2 has submitted the proposal to respondent No.1-State of Maharashtra on 28.03.2024 for seeking permission to entertain the aforesaid revision of the petitioners. The proposal dated 28.03.2024 is on record at Page No. 32 (Annexure-4).

Mr Dhandale, learned counsel for the petitioners submits that even after passage of more than one and half year

106.wp.574.2026.odt the aforesaid proposal is still pending with respondent No. 1 and the permission is not yet given to decide the revision of the petitioners. There are four other proposals sent alongwith aforesaid proposal pertaining to petitioners and they are also pending.

In view of the above, we dispose of the present writ petition with a direction to the respondent No. 1 to consider the proposal dated 28.03.2024, submitted by the respondent No.2 Additional Commissioner, Nagpur Division, Nagpur, for seeking appropriate permission under the proviso of Section 257 of the MLR Code, within a period of six weeks from the date of receipt of the order of this Court. 5.

The learned counsel for the petitioners undertakes to furnish a copy of this order before the respondent No.1.

The decision taken thereupon shall be communicated to the petitioners so also to respondent No.2 within a period of two weeks thereafter.

Accordingly, the writ petition stands disposed of. Pending applications, if any, also stand disposed of. No order as to costs.
