The petitioners have approached this Court seeking challenge to the impugned notice dated 14th January, 2026, issued by respondent No.1 - the Chief Officer, Municipal Council, Bhandara.

The contention is that the aforesaid impugned notice has been issued by the Chief Officer, Municipal Council, Bhandara, in utter violation of the provisions of the Maharashtra Regional and Town Planning Act, 1966. However, the fact remains that the petitioners are required to challenge the aforesaid impugned notice on the said ground before the appropriate Civil Court and seek the protection.

In view of the above, Shri. Quazi, learned counsel for the petitioners, upon instructions, seeks permission to withdraw the present writ petition with liberty to approach the learned Civil Court for challenging the impugned notice dated 14th January, 2026, issued by the Chief Officer, Municipal Council, Bhandara. Permission is granted.

The writ petition is disposed of as withdrawn with liberty as prayed for. However, in the meantime, respondent No.1 - the Chief Officer, Municipal Council, Bhandara, is directed not to act upon the aforesaid impugned notice dated 14th January, 2026, for a further period of four weeks.
