The petitioners have approached this Court seeking challenge to the impugned judgment dated 20/09/2024 passed by the learned Central Administrative Tribunal, Mumbai Bench, Mumbai in Original Application No.2151/2020.

By virtue of the aforesaid judgment, the learned Tribunal has directed the present petitioner-employer to pass appropriate order in accordance with law treating that the applicant (respondent herein) has completed 20 years of qualifying service on 25/08/2015 and thus was entitled for VRS and consequential benefits in accordance with law. 3.

Shri Choudhari, learned counsel has invited our attention to the order dated 17/02/2014 passed by the Joint Director (Administration), NADT, Nagpur whereby the unauthorised absence of the petitioner from 03/10/2013 to 17/02/2014 was treated as "Dies Non". Thus, there was a break in service of the petitioner. However, Shri Choudhari, learned counsel fairly admits that such order was not placed before the Tribunal when the impugned judgment was passed.

In view of above, Shri Choudhari seeks permission to withdraw the present petition to approach the Tribunal for filing review application pointing out the aforesaid order dated 17/02/2014. 5.

Permission granted.

Writ petition is disposed of as withdrawn with liberty as prayed for. No costs.
