Heard Shri Nitin Jaiswal, the learned counsel for the petitioner. 2.

The contention is that the petitioner, who was appointed as 'Labour' in Category I by the respondent no.2 on 14.01.20205, has been regularly promoted considering his hardworking nature and sincerity from Category I to Category IV. Even though the respondent no.1 has placed the present petitioner in the seniority list of Category IV employees for promotion to the post in Category V (Mechanical Fitter), the respondents are not promoting the present petitioner to the post in Category V (Mechanical Fitter).

Being aggrieved by the aforesaid act of the respondents, the Union-Bhartiya Koyla Khadan Majdoor Sangh has submitted a representation on 16.02.2025 to the respondent no.1 pointing out injustice caused to the petitioner, which is at record page no.19Annexure-4. Shri Jaiswal, the learned counsel submits that even after passage of almost one year, the aforesaid representation has neither been decided nor the respondent no.1 has given any reason for not promoting the petitioner to the post in Category V (Mechanical Fitter).

In that view of the matter, we dispose of the present writ petition with a direction to the respondent no.1 to decide the representation dated 16.02.2025 which is at record page 19 - Annexure -4, within stipulated period of four weeks from the date of receipt of copy of this order.

Decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision. 5.

Needless to clarify that we have not observed anything on the merits of the matter.

If the decision taken on the representation dated 16.02.2025 is adverse to the interest of the petitioner, then the petitioner is at liberty to approach this Court seeking challenge to the said decision.
