The petitioner seeks challenge to the order dated 18.09.2025 passed by the respondent No.1 - Joint Charity Commissioner, Civil Lines, Nagpur, whereby the application of the petitioner for appointment of 'New Trustees' under Section 47(1) of the Maharashtra Public Trust Act, 1950 is rejected.

However, the aforesaid judgment dated 18.09.2025 passed by the Joint Charity Commissioner, Nagpur, under Section 47(1) of the Maharashtra Public Trust Act, 1950, is appealable under Section 47(5) of the aforesaid act.

Accordingly, the learned counsel for the petitioners, upon instructions, seeks permission to withdraw the present writ petition with liberty to file appeal under Section 47(5) of the aforesaid act before the learned District Court.

In view of above, the writ petition is disposed of as withdrawn with liberty as prayed for.
